It is pretty clear from this post 3d Realms wants nothing to do with DNF
As far as what happens it sums up like this.
- DNF goes into endless production and this gets 3d Realms in some financial issues.
- Take 2 shells out some cash on the promise the game would be released and they get a part of the profit.
- 3dRealms downsizes and says no DNF coming.
- Take 2 says I don't think so and sues them.
- They settle and the end result looks like the game is being finished by 2k Games/Gearbox.
Feel free to correct me but that is what I have heard about all this in the past.

Erm... there were quite a few guys there from 3D Realms actually. Don't know if they stayed on or not from the first one or not, but there were a couple there. I may have been mistaken (I wasn't really paying too much attention) but it sounds like some of the guys from 3d have moved over to Gearbox.
Gearbox is developing, 2k is publishing.
As far as I know 3d Realms did retain rights, I guess by settled I mean "figured out a solution" Again this is all internet knowledge and as such could be faulty.

It's impossible to know without seeing the original contracts exactly how things are split up, so consider this non-legal trained speculation;
Publisher puts up a lot of money for a product. The developer commits to releasing that project and along the way hitting certain milestones..etc. Publisher, depending on amount put forward and invested, gets to ensure it meets a level of quality that they feel they paid for.
Depending on the deal sometimes publishers buy the rights to the project, in part of in full (think HALO and Microsoft from Bungie), and other times they are simply paying for that Intellectual Property for a given period of time or number of releases. So when 3D Realms couldn't deliver on the milestones, and eventually admitted failure to deliver the game...they were forced to shut it all down.
Take-Two has the right to sue them for ALL the money put in, and then some...which is what the suit was all about. Since they settled outside of everything I'm going to assume the details were that Take-Two would find a developer to finish the game, Take-Two will also earn the income from the game until they and Gearbox have earned their stake (whatever was agreed upon in the settlement)....and 3D Realms can go about licensing the product for other future titles or products, unless Take-two holds rights to more games.
In short, yes 3D Realms owns the game...but Take-Two pays the bills
I just want to know that George Broussard and Scott Miller (the owners of 3D Realms/Apogee, and creators of Duke 3D) are involved! I mean Duke Nukem 3D from 1996 was so damn good because those two (espicially George) were on the creative end of the game! How good can it be without them?
Yes I know George was the irresponsable one, always scrapping the DNF engine for a new engine, having pizza parties and strippers at 3D Realms headquarters and causing endless delays. But it was his creativity that made Duke what it was....
