I didn't discover that my PC wouldn't play this game until after I installed it and activated it (ATI X850). Fry's won't take back opened software. 2k doesn't respond to my emails. Am I just SOL with a $50 game that I can't play?

Did you actually try returning it? I.e. explaining that it was outlined on the box that you required a sm 3.0 shader card... hence you thought it would run on your pc? I'm sure they'd have to accept a return if you purchased the game under false information. This really should have been explicitly written on the box.

You are correct it DOES NOT SAY on the box that Shader 3.0 is required.
I too have an ATI X850 which MORE THAN MEETS the stated requirements on the box and it is on that basis I bought the product in the first place.
But to play devils advocate, the box does state you need a ATI X1550 or higher to play it so there is a chance your refund may get deinied.
However, if you mention the fact that you did not agree with the 2 limit install policy as procured by securom as it is a violation of the EULA listed on page 34, then you have a fighting chance
Actually it states it needs a ATI X1300 or higher. Many people consider X800s 'higher' then X1300s because they are in nearly every way except for the lack of SM3.0 support. It does also mention DX9.0c although as explained elsewhere this is confusing as well. In reality, I suspect that 2k or the store could argue in a court of law that the requirements as specified were sufficiently clear even though they really should have specified the SM3.0 requirement IMHO. However they may not want to go that far so I strongly suspect you could get them to take it back if you try hard enough. Of course the EULA issue sounds much more promising to me.
I did try to return it. The punk at the return counter actually laughed at me for trying to return an opened game.
Not if you followed my advice it wouldnt. Also, if he laughs, ask to speak to the manager and tell him that the game was fasly advertised to you on the box and that the entire production is faulty until a patch is made. If he refuses, ask for the district phone number and use their own phone at guest service to call the district.
Eventually, you will get it returned. If all else fails, return it to 2K.

2) Take it back and say your disk is scratched and you want to swap it
3) Take your shiny new UNOPENED replacement and return it
I was able to return mine by explaining the situation.
Returned it where? I've spoken to two different Frys people and they refuse.
I just got off the phone with 2k support. They refuse to acept any returns and stick by "the x1300 it better than the x850". The support person refused to allow me to escalate the issue and said I could not talk to a manager. I spoke to John and my incident number is 07082300694.
Needless to say I will never purchase a 2k game again. I don't play games all that much and I'm sure I can live without whatever they publish.
No one from 2k games has returned any of my emails either. What a racket. I'm tempted to look for a lawyer just out of principle even if it costs me money.
