BioShock freezing my 360

I just picked up the game at midnite from walmart and i played through the first section. Now every time i load the game my xbox freezes (not rings of death). i have to turn it off and load again. i can play for a couple min then BAM freezes again. anyone else having this issue or is my copy just bad?

now i turned the 360 on without the game on and wala THREE RINGS OF DEATH. just my luck i have been waiting so long for this game and my box dies. guess its time for the towel trick and trade this thing in. gonna get a 65nm box.
