I think the issue is your 4GB of memory. People with 4GB have reported crashes elsewhere. Consider pulling half your RAM just to test and see if the crash goes away. Hopefully this will be fixed in the upcoming patch... whenever that happens. I'm running this setup:
C2D E6420 @ 3.2Ghz
eVGA 122-CK-NF68-T1 680i SLI
2GB DDR2-800 4-4-4-12
OCZ 8800 GTX (watercooled, 675Mhz core, 910Mhz memory)
Onboard Realtek HD audio
Vista Ultimate 64bit
No issues. Forceware 163.44, Realtek HD audio drivers 1.73.

I'm using Vista 64 Ultimate with 4GB and have no graphical issues. Also have 8800GTX, and the 163.44 beta drivers that have bioshock compatibility fixes in them.

tnx for the responce, im not pulling memory out (its just a game!) but thanks for the tip. my main differences are quad core and emu soundcard (0404)- the freeze is when the load screen starts, it is dim (but there) but gets stuck and never starts the game. everything works dx9, just 10x that fails!?
i have the latest 10 patch and nvidea betas etc

QuadCore
NVidia 8800
4Gigs
runs fine for me.
Vista x64, nVidia 8800 GTS 640 meg, 4 gigs of ram.
one issue i do have however, is if i don't put my Trillian into away mode, and i receive an IM, the sound seems to make the game freeze up.

If you're having problems, try this:

And see if it helps.

No problems here with DX10 on an 8800 GTS with 163.44 drivers, well, apart from tripple buffering not working and not being able to force it (anyone got a solution to this?), so I have to put up with tearing.
It's better than running DX9 under Vista (32bit) which crashes when I hack things, or DX9 under XP which crashes fairly often when I load a save or load a new zone unless I turn High Detail Shaders off.

Visit these couple:

The latter has a bunch of comparisons before the DX9 vs. DX10, but might be interesting to look at all the same.

Try the following linkages for a better example of the difference between Dx9 and Dx10. Watch the video for an even better insight.

I'm using DX10 with no issues...
Ditto,with a Asus P5K-Dlx , Q6600 @ 3.167Ghz using a Thermalright Ultima 90 , eVGA 8800 GTS 640 + ACS3 @ 590/1.86Ghz , Vista Ultimate x86 , X-Fi Platinum + Alchemy , 163.44 Beta (Bioshock)
No crashes or blue screens and its runs about the same performance wise as
it does on XP Pro+SP2.

Can anyone tells the difference when playing though? I notice some of the shadows are sharper, and I suppose the fog effects and particles are smoother, but that's about it.

The water effects are different for sure.More detailed in DX10.

I had a few problems when running Bioshock at first (using DX10) random CTDs etc (E6320, 4gb ram, vista ultimatex86, 8800gtx, on-board sound)
Everything driver wise was upto date, oddly tho, re-installing Openal solved my issues
grab it here (http://www.openal.org/downloads.html)
