Bioshock crash when starting new game

sarp yall.

just installed bioshock on a brand new machine i built yesterday, and it doesnt want to play ball. click new game, goes to loading screen, after a couple seconds, music stops and it crashes to desktop saying "must close blah blah blah"

system:

Intel Q9450 2.66ghz
OCZ Reaper 1066mhz 4gig
EVGA 750i SLI FTW
XFX 9800GX2 1gig XXX edition
Vista ultimate 64 bit.

any ideas?

Did you patch it? If yes, reinstall and don't patch.

ive managed to solve that problem by updating dx10 to a later version, but now when i try to save or load past the elevator ride, it crashes. making me sad in teh pantz T_T
